2. Scope

These Terms & Conditions govern access to and use of the instapi.io platform and API. By creating an account or using the service, you agree to these Terms.

The platform is under active development. Features may be added, changed, limited, or discontinued at any time.

3. Description of the Service

quqii Social Media Feed provides an API that retrieves, caches, and serves publicly available Instagram profile data — including profile information, post images, and videos — via a simple HTTP interface.

The service acts as a caching and delivery layer. It does not store private data and only processes publicly accessible Instagram profiles. Availability of data depends on Instagram's own platform and terms.

4. Account Registration

Access to the API requires registration with a valid email address. You are responsible for keeping your login credentials and API token confidential and for all activity carried out through your account.

You must provide accurate and up-to-date information. The operator may refuse registration or suspend accounts in cases of misuse, false information, or violation of these Terms.

5. API Token and Permitted Use

Upon registration, you receive a personal API token. This token grants access to the quqii Social Media Feed API within the limits of your subscription plan.

You may use the API only for lawful purposes. The following is prohibited:

6. Subscription Plans and Billing

quqii Social Media Feed offers a free plan and paid subscription plans. Paid plans are billed monthly in advance via Stripe.

Subscriptions renew automatically each month unless cancelled before the end of the current billing period. You may cancel at any time; access to the paid plan continues until the end of the already-paid period.

Plan limits (API calls, Instagram pulls, maximum posts) are defined per plan and reset monthly. Unused quota does not carry over.

7. Payments via Stripe

All payments are processed by Stripe Payments Europe, Ltd. By making a payment, you may also be subject to Stripe's own terms and conditions. instapi.io does not store payment card details.

8. Refunds

Unless required by mandatory consumer protection law, subscription fees are non-refundable. No partial refunds are issued for unused time after cancellation or account suspension.

Where you qualify as a consumer under applicable law, mandatory statutory withdrawal rights may apply. If a paid digital service begins before the end of a statutory withdrawal period, you may be asked to consent to immediate performance, which may affect your withdrawal right.

9. Service Availability

We aim to provide reliable and uninterrupted access to the API. However, we do not guarantee availability, error-free operation, or the continued availability of specific features.

The service may be temporarily unavailable due to maintenance, updates, technical issues, or events outside our control. Availability of Instagram data further depends on Instagram's own platform.

10. Data and Privacy

instapi.io only processes publicly available Instagram data. You are responsible for ensuring that your use of this data complies with applicable data protection laws, including the GDPR, in your own applications and websites.

11. Intellectual Property

All rights in the quqii Social Media Feed platform — including software, design, branding, and technical infrastructure — remain with the operator or its licensors. You may not copy, reverse engineer, redistribute, or exploit any part of the platform without prior written permission.

12. Limitation of Liability

The operator is liable without limitation for intent, gross negligence, injury to life, body, or health, and where liability is mandatory under applicable law.

In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable, typical damages.

The operator is not liable for the availability, accuracy, or completeness of Instagram data, for changes to Instagram's platform or API, or for damages arising from third-party service outages.

13. Indemnification

You agree to indemnify and hold the operator harmless from claims, damages, and costs arising from your misuse of the API, violation of these Terms, violation of applicable law, or infringement of third-party rights.

14. Account Termination

You may stop using the service and request deletion of your account at any time by contacting info@quqii.com.

The operator may suspend or terminate accounts in cases of serious or repeated violations of these Terms, legal obligations, or misuse of the service.

15. Changes to These Terms

We may update these Terms from time to time. Users will be informed of material changes where legally required. Continued use of the service after updated Terms have taken effect constitutes acceptance, where legally permitted.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules. Mandatory consumer protection laws of the user's country of residence remain unaffected.

17. Dispute Resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply. The invalid provision shall be replaced by the applicable statutory rule.
